Inhalation of asbestos fibers, over time, can cause lung cancer. With this discovery came a high number of lawsuits. Simple exposure led many to file a claim for mesothelioma compensation. It was these court cases that gave funds to those who didn't necessarily need it, while those who did went without.

Insurance companies were going broke. In 1999 the US government set a number of guidelines in place. Suits could no longer be filed on exposure alone. It now took an affirmative diagnosis by a physician in order to file.

The Fairness in Asbestos Act would seem detrimental to those exposed. What it did was rid the courts of frivolous lawsuits. These lawsuits were using up monetary resources available for those that needed paid damages. People with legitimate claims could now get money to pay for their treatments.

Proving this disease is difficult. Symptoms are non-specific and many delay treatment. It takes many years for those afflicted to develop cancer, but once they do, the condition spreads rapidly. Most states now have a deadline that must be followed after diagnosis if they hope to receive a stipend.

One of the devastating realities of this form of cancer, is the right a survivor has to file for compensation. When a relative passes away from this cancer a wrongful death suit can be filed. Attorneys need to prove wrongful death and many co-workers will be interviewed. Still, the medical diagnosis is difficult for anyone to disclaim.

Lawyers will handle cases on a contingency basis. Fees is variable but typically between 30% and 40%. The amount of mesothelioma compensation can be anywhere from one to three million dollars. This is because factors like severity and how long you have had the illness both apply. If you feel you may have this devastating illness that causes cancer, be tested as soon as possible.
